Welcome to Aviha. These Terms and Conditions ("Terms") govern your access to and use of the website, applications, and AI-powered services provided by Aviha Technologies Private Limited ("Aviha," "we," "us," or "our").

By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you must not use the Services.

1. Introduction and Acceptance of Terms

Aviha provides an AI-powered platform designed for task automation and fulfillment. These Terms constitute a legally binding agreement between you (whether as an individual or on behalf of an organization) and Aviha Technologies Private Limited.

By using Aviha on behalf of an organization, you represent that you are authorized to accept these Terms on that organization's behalf. You must be at least 18 years of age to use the Services.

2. Description of Services

Aviha provides intelligent task fulfillment services using a combination of proprietary artificial intelligence, third-party Large Language Models (LLMs), and human-in-the-loop processing.

• AI Processing: You acknowledge that your prompts and inputs are processed by AI models which may generate content that is probabilistic in nature.
• Human-in-the-Loop: To ensure high-quality task fulfillment, you explicitly agree that authorized Aviha team members may access your non-anonymized data to manually assist in completing complex tasks or troubleshooting.
• Modifications: We reserve the right to modify, suspend, or discontinue any part of the Services at any time without prior notice.

3. User Accounts and Security

To access certain features, you must create an account via your phone number (SMS/WhatsApp OTP) or supported SSO providers.

• Responsibility: You are solely responsible for all activity that occurs under your account.
• Accuracy: You agree to provide truthful and complete information during registration.
• Unauthorized Use: You must immediately notify us at hello@aviha.ai of any security breach or unauthorized use of your account. We are not liable for any losses caused by unauthorized access to your account.

4. Acceptable Use and Restrictions

You agree not to:

• Violate Laws: Use the Services for any unlawful purpose, including the generation of harmful, defamatory, or infringing content.
• Abuse AI:Attempt to "jailbreak" or circumvent the safety filters of the AI models.
• Interfere: Attempt to disrupt the integrity or performance of the platform or its related systems.
• Reverse Engineer: Decompile, disassemble, or attempt to extract the source code or underlying algorithms of the Aviha platform.
• Automated Access: Use bots or scrapers to access the Services in a way that exceeds reasonable human usage patterns.

5. Intellectual Property Rights

• Aviha Ownership: We retain all rights, title, and interest in the platform, including software, logos, algorithms, and technical documentation.
• User Content: You retain ownership of the inputs (prompts) you provide. However, you grant Aviha a worldwide, non-exclusive, royalty-free license to use, host, and process your content to provide the Services and for the purposes of AI training and model improvement (unless otherwise agreed in an Enterprise contract).
• Feedback:Any suggestions or ideas you provide regarding Aviha ("Feedback") may be used by us without any obligation or compensation to you.

6. Privacy and Data Usage

Your use of the Services is also governed by our Privacy Policy. Please review it to understand how we collect and use your data, including our use of phone numbers for OTP authentication and our practices regarding AI training with non-anonymized data.

7. Third-Party Integrations

Aviha integrates with third-party services (e.g., OpenAI, Anthropic, Mixpanel, WhatsApp/Meta). Your use of these integrations is subject to the respective third parties' terms and conditions. Aviha is not responsible for the acts or omissions of these third-party providers.

8. Termination

• By You: You may stop using the Services at any time. To delete your account and all associated personal data, please send a written request to hello@aviha.ai. We will process your request within the timeframe specified in our Privacy Policy.
• By Us: We may suspend or terminate your access immediately if you violate these Terms, create legal risk for us, or if the provision of Services is no longer commercially viable.
• Effect: Upon termination, your right to use the Services ceases immediately. We may delete your data after a reasonable period as specified in our Privacy Policy.

9. Disclaimer of Warranties

AVIHA IS PROVIDED ON AN "AS-IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE AI-GENERATED OUTPUTS WILL BE ACCURATE, COMPLETE, OR RELIABLE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AVIHA TECHNOLOGIES PRIVATE LIMITED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR INR 5,000, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify and hold harmless Aviha and its officers, directors, and employees from any claims, damages, or expenses (including legal fees) arising from your use of the Services, your violation of these Terms, or your infringement of any third-party rights.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka, India.

13. Miscellaneous

• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
• No Waiver: Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right.
• Entire Agreement: These Terms (along with the Privacy Policy) constitute the entire agreement between you and Aviha.
